Do I Need a CDL? Passenger-Vehicle CDL Checker
Whether a chauffeur needs a commercial driver's license depends on the vehicle's designed passenger capacity (including the driver) and the state. Pick your state and enter the capacity to see the answer — plus whether a DOT medical card comes with it.
How the thresholds work
- Federal (FMCSA): a CDL with a passenger (P) endorsement is required for any vehicle designed to carry 16 or more people including the driver.
- California: stricter — a Class B CDL with passenger endorsement is required for vehicles designed for more than 10 persons including the driver, operated for hire (11+).
- Illinois: follows the federal 16+ trigger; a standard Class D covers smaller vehicles. Separately, drivers of 10+ passenger vehicles for compensation must be 21+ with a year of experience.
- New York: a NYS For-Hire Class E license covers standard for-hire vehicles; a CDL is required for larger vehicles. The exact seat threshold is a TLC/DMV detail we recommend confirming directly.
It's the vehicle's design capacity that counts — a 15-seat van "designed for 15" is measured by its seats, not how many you carry.
