Terms of Service
These Terms of Service (the “Terms”) are an agreement between VettyFleet (“VettyFleet,” “we,” “us”) and the company or person that creates a VettyFleet account (“you,” the “Operator”). They govern your use of the VettyFleet websites and the application at app.vettyfleet.com (together, the “Service”). By creating an account or using the Service, you accept these Terms on behalf of your company and confirm you have authority to do so.
1. What the Service is
VettyFleet is software that helps chauffeured-transportation operators track regulatory credentials — licenses, permits, inspections, insurance filings, drug-and-alcohol testing programs, and similar requirements — across federal, state, city, and airport jurisdictions. The Service computes compliance status from the dates and documents you enter, maintains a random-testing pool tool, and produces exportable audit packets.
2. Not legal advice
VettyFleet is a record-keeping and reminder tool, not a law firm, compliance consultancy, or government agency. Rule content in the Service is provided for general information. It may be incomplete, out of date, or inapplicable to your specific operation, and it is not legal advice. You remain solely responsible for determining and meeting your regulatory obligations. Using the Service — including a “cleared for dispatch” status — does not guarantee that you, your drivers, or your vehicles comply with any law, and does not shift responsibility for compliance to VettyFleet.
3. Your account and team
- You must provide accurate account information and keep your credentials confidential. You are responsible for all activity under your account.
- You may invite team members into your company portal. Everyone you invite acts on your behalf, and you are responsible for their use of the Service.
- Notify us promptly of any unauthorized use of your account.
4. Trials, subscriptions, and billing
- New accounts get a 30-day free trial. When the trial ends, continued access requires an active paid subscription.
- Plans and current pricing are described on the pricing page. Fees are based on your plan and the number of active drivers — deactivated drivers are not billed.
- Payments are processed by Stripe. We do not store your card details.
- Subscriptions renew automatically each billing period until canceled. You can cancel any time from the billing page; cancellation takes effect at the end of the period already paid for, and except where the law requires otherwise, fees are non-refundable.
- We may change prices with at least 30 days' notice; changes apply from your next renewal.
5. Your data
- The records you enter or upload — driver and vehicle details, credential dates, documents, testing records (“Customer Data”) — belong to you. You grant us a license to host and process Customer Data only as needed to provide the Service.
- You are responsible for having the right to put Customer Data into the Service, including any consents or notices your drivers are owed for personal information such as license numbers, medical certificate dates, and drug-and-alcohol testing results.
- You can export your records (audit packets and documents) at any time while your subscription or trial is active. Handling of personal information is described in the Privacy Policy.
6. Acceptable use
You agree not to: misuse or probe the Service outside your own account; interfere with its operation; upload malicious code; use it to violate the law or others' rights; resell it; or use it to build a competing product. We may suspend accounts engaged in abuse.
7. Availability and changes to the Service
We aim to keep the Service available and your data safe, but the Service is provided without an uptime guarantee, and we may change or improve features over time. If we ever discontinue the Service, we will give reasonable notice and a window to export your data.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT RULE CONTENT OR COMPLIANCE STATUSES ARE ACCURATE, COMPLETE, OR CURRENT.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, VETTYFLEET WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, FINES, PENALTIES, OR REGULATORY SANCTIONS, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.
10. Indemnification
You will defend and hold VettyFleet harmless from claims arising out of your Customer Data, your violation of these Terms, or your violation of law — including claims by your drivers or employees relating to information you chose to store in the Service.
11. Termination
You may stop using the Service and cancel at any time. We may suspend or terminate your account for material breach of these Terms or non-payment, with notice where practicable. After termination we will retain and then delete your data as described in the Privacy Policy; you may request an export first.
12. Changes to these Terms
We may update these Terms from time to time. For material changes we will give notice by email or in the app at least 14 days before they take effect. Continuing to use the Service after that date means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in New York, and both parties consent to their jurisdiction.
