What Happens If a Driver Fails a DOT Drug Test?
A driver who fails — or refuses — a DOT drug or alcohol test must be removed from all safety-sensitive duties immediately, and can't drive again until completing the federal return-to-duty process with a Substance Abuse Professional (49 CFR 40.23). The violation is reported to the FMCSA Clearinghouse, where it follows the driver.
What happens immediately after a failed test?
The employer must pull the driver from every safety-sensitive function the moment a positive result or refusal comes back — no "finish today's runs." A refusal (including a no-show or a tampered sample) counts as a violation just like a positive.
What is the return-to-duty (RTD) process?
The driver can't simply retest their way back. Under 49 CFR Part 40, Subpart O:
- SAP evaluation — a Substance Abuse Professional evaluates the driver and prescribes education and/or treatment.
- Complete the program and be re-evaluated as having complied.
- Return-to-duty test — a directly observed test with a negative result.
- Follow-up testing — at least six unannounced tests in the first 12 months, and the SAP can extend the plan up to five years.
What does the employer have to do?
Remove the driver, keep them out of safety-sensitive work until RTD is complete, report the violation to the Clearinghouse, and document everything. Skipping the removal — letting a prohibited driver keep dispatching — is exactly the finding that turns an audit into a fine.
